These Terms of Service (“Terms”) govern your access to and use of the website www.africanpride.co and all related products, content, features, communications, and services offered by African Pride Shop, operated by KONICUS LLC (collectively, the “Services”).

By accessing our website, creating an account, placing an order, subscribing to communications, or otherwise using the Services, you agree to be bound by these Terms and the policies incorporated into them by reference.

If you do not agree to these Terms, you must not access or use the Services.

Nothing in these Terms is intended to exclude, restrict, or waive any consumer right that cannot lawfully be excluded, restricted, or waived.

Our United States return warehouse is not a retail store, customer-service office, or walk-in location. It does not accept unauthorized packages.

Do not send a product to the return warehouse unless African Pride Shop has provided written Return Authorization and confirmed the correct return address.

2. Eligibility and Acceptance of Terms

By using the Services, you represent that you are at least the age of majority in your state, province, territory, or country of residence.

If you have not reached the age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian where permitted by law.

You may not use the Services if your use would violate applicable law, trade restrictions, sanctions, court orders, or another binding legal obligation.

Your continued use of the Services after an updated version of these Terms takes effect constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.

3. Accounts and Customer Information

You agree to provide accurate, current, and complete information when creating an account, submitting an order, contacting customer support, or using the Services.

You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • Restricting unauthorized access to your account;
  • Providing a valid billing address and shipping address;
  • Providing a working email address and telephone number;
  • Reviewing your product, size, color, design, personalization, quantity, and shipping information before checkout; and
  • Promptly notifying us of suspected unauthorized account activity.

You are responsible for activity conducted through your account except to the extent that applicable law provides otherwise.

We may suspend or terminate an account when we reasonably believe it is being used for fraud, abuse, unlawful conduct, unauthorized payment activity, policy circumvention, or conduct that threatens the security or operation of the Services.

4. Products and Made-to-Order Production

Many African Pride Shop products are custom-made, printed, personalized, or manufactured after an order is submitted.

Production may begin shortly after purchase. Processing may include artwork preparation, printing, manufacturing, quality review, packing, and transfer to a shipping carrier.

Because products are often made specifically for an individual order, cancellation, modification, return, and refund rights are subject to the timeframes and procedures stated in these Terms and our Return & Refund Policy.

We may modify or discontinue a product, design, color, size, material, feature, or product description. Such changes will not remove rights relating to an order that we have already accepted, except where a substitution is approved by the customer or permitted by law.

5. Product Information and Print-on-Demand Tolerances

We make reasonable efforts to present product descriptions, size information, photographs, digital mockups, colors, and other content accurately.

Actual product appearance may vary because of:

  • Screen settings and display calibration;
  • Lighting conditions;
  • Product materials and fabric texture;
  • Garment construction;
  • Printing or manufacturing processes; and
  • Normal variations between production batches.

Minor color differences between a digital display and a physical product are not necessarily defects.

For print-on-demand products, a minor design-placement difference of up to approximately 1–2 inches from a digital mockup may fall within normal production tolerance, provided the product is otherwise correctly made and usable.

A substantial printing error, materially misplaced design, incorrect orientation, defective print, wrong product, or another verified production error remains eligible for review under our Return & Refund Policy.

6. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated confirmation email acknowledges that we received your order. It does not necessarily mean that the order has been finally accepted.

We may accept, reject, review, limit, or cancel an order for reasons including:

  • Suspected fraud or unauthorized payment activity;
  • Incorrect pricing or product information;
  • Technical or website errors;
  • Production or inventory limitations;
  • Shipping restrictions;
  • Sanctions or legal-compliance requirements;
  • Abuse of promotions, discounts, refunds, or replacement procedures;
  • Unusually large or repetitive orders;
  • Resale activity that has not been approved by us; or
  • Violation of these Terms or another applicable policy.

If we cancel an order after collecting payment and the cancellation is not caused by a payment reversal or chargeback, we will return the applicable amount to the original payment method.

We may limit quantities available per customer, household, account, payment method, billing address, shipping address, or order.

7. Pricing, Currency, and Payment

Prices are displayed in United States dollars (USD) unless checkout expressly displays another currency.

The total shown at checkout may include:

  • Product charges;
  • Shipping charges;
  • Applicable sales or transaction taxes collected by us; and
  • Other charges clearly disclosed before order submission.

International customers may separately owe import duties, value-added taxes, customs charges, brokerage fees, or local carrier charges. These amounts are governed by our Shipping & Delivery Policy.

Payment must be authorized before an order is processed. Available payment methods may include credit or debit cards, PayPal, Shop Pay, or other payment methods shown at checkout.

By submitting payment information, you authorize the applicable payment provider to charge the total amount displayed at checkout.

We do not directly store complete payment-card numbers on our own servers. Payments are processed by third-party providers under their own security standards, terms, and privacy practices.

If an obvious pricing or technical error occurs, we may cancel the affected order and refund the amount paid, subject to applicable law.

8. Cancellations and Order Modifications

Order cancellation: A cancellation request submitted within 24 hours of ordering qualifies for a full refund, even if production has started.

Item modification: A request to change the size, color, or design must be submitted within 24 hours of ordering.

Address modification: A request to change the shipping address must be submitted within 48 hours of ordering.

Send a cancellation or modification request to contact@africanpride.co. Include the order number and the exact action requested.

We will make reasonable efforts to apply an eligible modification. An address change cannot be guaranteed after an order has been dispatched or transferred to a shipping carrier.

After the 24-hour cancellation period, a correctly made product does not qualify for a free change-of-mind refund. Available post-24-hour resolutions are stated in our Return & Refund Policy.

9. Shipping and Delivery

Total delivery time consists of processing time plus shipping transit time.

Processing times, shipping rates, delivery estimates, carrier information, tracking procedures, address limitations, customs responsibilities, and delayed-delivery procedures are provided in our Shipping & Delivery Policy, which forms part of these Terms.

Delivery dates are estimates unless African Pride Shop expressly confirms a guaranteed delivery deadline in writing.

Delivery may be affected by production demand, carrier operations, customs inspections, weather, public emergencies, incorrect addresses, regional restrictions, labor disruption, or circumstances outside our reasonable control.

If an order has not arrived within 30 business days from dispatch, the customer should contact us so we can investigate.

A tracking status of “Delivered” does not automatically qualify an order for a refund or replacement. Delivered-but-not-received claims may be subject to a carrier investigation.

10. Returns, Refunds, and Replacements

Returns, refunds, replacements, product claims, change-of-mind requests, wrong-size requests, personalization errors, damaged products, defective products, lost orders, and late deliveries are governed by our approved Return & Refund Policy.

Product claims relating to a delivered order generally must be submitted within 30 days from delivery.

Lost or never-delivered orders must be reported within 30 days after the latest estimated delivery date.

Claims are reviewed and approved or rejected by email within 2 business days after we receive the claim and required evidence.

Approved refunds are processed to the original payment method within 3–5 business days. After processing, PayPal refunds generally appear within 3–5 business days, while credit or debit card refunds may take 10–15 business days to appear.

Only one primary resolution is provided for each approved issue.

No physical return may be sent without written Return Authorization and confirmation of the correct return address. Unauthorized packages may not be processed.

11. SMS Marketing and Mobile Messages

By providing a mobile telephone number and affirmatively opting in, you consent to receive recurring automated or non-automated text messages from African Pride Shop where permitted by law.

Messages may include:

  • Promotional offers;
  • Product announcements;
  • Abandoned-cart reminders;
  • Order and delivery updates;
  • Customer-service communications; and
  • Other marketing or transactional messages.

Consent to receive marketing messages is not a condition of purchase.

Message frequency may vary. Message and data rates may apply according to your mobile carrier and service plan.

You may opt out of marketing messages at any time by replying STOP to a message. After an opt-out request, we may send one confirmation message.

Where supported, reply HELP for assistance or email contact@africanpride.co.

Mobile carriers are not responsible for delayed or undelivered messages.

We may modify, suspend, or discontinue an SMS program where permitted by law.

We do not sell, rent, or share SMS opt-in records, SMS consent information, or telephone numbers collected for SMS marketing with third parties for those third parties’ independent marketing purposes.

12. Email Marketing and Promotional Communications

If you subscribe to email marketing, you may receive newsletters, promotions, product announcements, abandoned-cart reminders, and other marketing communications from African Pride Shop.

You may unsubscribe from promotional emails at any time by using the unsubscribe link included in the email or by contacting contact@africanpride.co.

After unsubscribing from marketing, you may continue to receive transactional or service-related communications concerning:

  • Orders and payments;
  • Shipping and tracking;
  • Returns, refunds, or claims;
  • Account security;
  • Customer-service requests;
  • Policy changes; or
  • Legal or regulatory notices.

Our collection and use of personal information are further described in our Privacy Policy.

13. Intellectual Property Rights

All content made available through the Services, including website text, product photographs, graphics, artwork, designs, logos, videos, icons, product descriptions, page layouts, software, branding, and other materials, is owned by or licensed to KONICUS LLC, African Pride Shop, or their respective licensors, suppliers, designers, and content partners.

Except where permitted by law or expressly authorized by us in writing, you may not:

  • Copy, reproduce, republish, or distribute content;
  • Modify or create derivative works;
  • Sell, resell, license, or commercially exploit content;
  • Scrape, crawl, mirror, frame, or systematically download content;
  • Remove copyright, trademark, or ownership notices;
  • Use our branding in a misleading or unauthorized manner; or
  • Use website content to train, develop, or operate a commercial dataset or competing service without authorization.

A limited, revocable, non-exclusive, and non-transferable right is granted to access the Services for lawful personal shopping and informational purposes.

No ownership interest in our intellectual property is transferred to you.

14. DMCA Copyright Procedure

African Pride Shop respects intellectual property rights.

If you are a copyright owner or an authorized agent and believe that material available through the Services infringes a copyrighted work, you may submit a written notice under the Digital Millennium Copyright Act (“DMCA”).

Send the notice to contact@africanpride.co and include:

  • Your full legal name, mailing address, telephone number, and email address;
  • Identification of the copyrighted work claimed to have been infringed;
  • The exact URL or a sufficiently clear description of the allegedly infringing material;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law;
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the copyright owner; and
  • Your physical or electronic signature.

We may remove or restrict access to material after receiving a valid notice.

We may notify the person who submitted or posted the affected material and provide information about the notice where appropriate.

Counter-Notification

If you believe that material was removed or disabled because of mistake or misidentification, you may submit a counter-notification containing:

  • Your full legal name, address, telephone number, and email address;
  • Identification of the material removed or disabled and its former location;
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification;
  • A statement consenting to the jurisdiction required under applicable DMCA procedures and accepting service of process from the person who submitted the original notice or that person’s agent; and
  • Your physical or electronic signature.

Submitting a false or materially misleading DMCA notice or counter-notification may result in legal liability. Consider obtaining legal advice before submitting one.

15. Prohibited Uses

You may not use the Services:

  • For an unlawful, fraudulent, deceptive, abusive, or unauthorized purpose;
  • To violate intellectual property, privacy, publicity, consumer protection, or other rights;
  • To submit false account, payment, shipping, claim, or identity information;
  • To obtain multiple refunds, replacements, credits, or discounts for the same issue;
  • To misuse chargebacks or payment disputes;
  • To upload malware, viruses, destructive code, or harmful content;
  • To interfere with website security, availability, or operation;
  • To access another person’s account without authorization;
  • To collect or track personal information without lawful authorization;
  • To scrape, crawl, harvest, or extract content or data through automated means without written permission;
  • To impersonate another person or misrepresent an affiliation;
  • To transmit spam, phishing messages, or misleading communications;
  • To circumvent technical, geographic, payment, or security controls; or
  • To encourage or assist another person in prohibited conduct.

We may investigate suspected violations and may suspend access, cancel affected orders, preserve relevant records, or cooperate with payment providers, carriers, regulators, or law-enforcement authorities where appropriate.

16. Third-Party Services, Links, and Tools

The Services may rely on or link to third-party platforms and providers, including payment processors, ecommerce technology providers, analytics services, marketing providers, manufacturers, fulfillment partners, and shipping carriers.

Third-party services may be governed by their own terms, privacy notices, and operating procedures.

We do not control and are not responsible for the content, availability, accuracy, security, policies, or practices of an independent third-party website or service, except to the extent responsibility cannot lawfully be excluded.

A link to a third-party service does not necessarily constitute endorsement.

You are responsible for reviewing applicable third-party terms before using an external service.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and Services are provided on an “as is” and “as available” basis.

We do not warrant that:

  • The Services will always be uninterrupted, secure, or error-free;
  • Every website error will be corrected immediately;
  • The Services will be compatible with every device or browser;
  • Third-party services will remain available;
  • Delivery estimates will always be met; or
  • Website content will be free from every typographical, technical, or display error.

This disclaimer does not apply to an express product remedy stated in our policies, a written warranty that we provide, or a right or warranty that cannot lawfully be excluded.

Products that are defective, damaged, incorrect, or materially not as described remain subject to the remedies stated in our Return & Refund Policy and applicable consumer law.

18. Limitation of Liability

To the fullest extent permitted by applicable law, KONICUS LLC, African Pride Shop, and their owners, officers, employees, contractors, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of or inability to use the Services.

Such losses may include loss of profits, revenue, savings, data, business opportunity, reputation, or anticipated benefit.

To the fullest extent permitted by law, our total liability arising from a particular order will not exceed the amount paid to African Pride Shop for the product or order giving rise to the claim.

Mandatory consumer-rights exception: Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence where liability cannot be limited, or any warranty, remedy, statutory right, or other liability that cannot lawfully be excluded or limited.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the applicable limitation will apply only to the maximum extent permitted by law.

19. Indemnification and Governing Law

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless KONICUS LLC, African Pride Shop, and their owners, officers, employees, contractors, licensors, suppliers, and service providers from third-party claims, losses, damages, liabilities, and reasonable costs arising from:

  • Your unlawful use of the Services;
  • Your material violation of these Terms;
  • Your infringement of another person’s rights;
  • Content or information submitted by you; or
  • Fraudulent, abusive, or unauthorized activity conducted through your account.

This obligation does not apply to the extent that a claim was caused by African Pride Shop’s breach, negligence, unlawful conduct, or another responsibility that cannot legally be transferred to you.

Governing Law

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or a purchase from African Pride Shop will be governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any legal proceeding arising from these Terms or the Services must be brought before a court of competent jurisdiction located in Colorado, United States.

Mandatory consumer-rights protection: This choice of Colorado law and jurisdiction does not deprive a consumer of any mandatory protection available under the laws of the consumer’s country, state, province, territory, or habitual place of residence when those protections apply regardless of a contractual choice of law or forum.

Before commencing formal legal proceedings, you and African Pride Shop are encouraged to contact one another and make a good-faith effort to resolve the dispute informally.

20. General Provisions and Contact Information

Changes to These Terms

We may update these Terms to reflect operational, legal, regulatory, security, or business changes.

The updated version will be posted on this page with a revised “Last updated” date. Where required by law, we will provide additional notice or obtain consent.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the remaining provisions. The remaining provisions will continue in effect.

No Waiver

A failure or delay in enforcing a provision does not waive the right to enforce that provision later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, financing, or transfer of the business, subject to applicable law.

Entire Agreement

These Terms, together with the policies incorporated by reference and any order-specific terms shown at checkout, constitute the agreement between you and African Pride Shop concerning the Services.
